Retail stores, markets or department stores should avoid selling regulated products that do not bear the Commodity Inspection Mark or labels. Sale of products that are announced by the BSMI to be prohibited from being placed on the market for sale violates the Commodity Inspection Act. The BSMI may detain, confiscate or destroy such products and the seller will be imposed a fine in an amount of not less than NTD 10,000 but not more than NTD 100,000.

In order to ensure that regulated products placed on the market comply with related requirements, the BSMI may dispatch its staff members to the place of display and sale of commodities to conduct market surveillance in accordance with Articles 49, 50 and 51 of the Commodity Inspection Act. Where it is deemed necessary, the suspect commodity will be sealed up and placed under the custody of the sales agents against an undertaking or transported to a designated place for storage. Parties subject to such checks, investigations or sealing-up of suspect commodities shall not evade, impede or reject such procedures. Violators will be imposed a fine in an amount of not less than NTD 150,000 but not more than NTD 1,500,000.
